Section 108 of the Railway Act makes Konkurentsiamet the body that monitors the competitive situation on the rail services market and states in terms that it is also the regulatory body within the meaning of Directive 2012/34/EU; it checks on its own initiative whether the network statement contains discriminatory provisions or confers discretion that could be used to discriminate between applicants for capacity. Section 143(3) gives it competence over accounting separation, over the licences in section 12(1) points 1 to 3, over supervision of the contracts in section 77(5) and over complaints under section 109. Its own rail page states that a railway undertaking may complain to it where an infrastructure manager has treated it unfairly in approving the network statement, allocating capacity, running the coordination procedure, declaring capacity exhausted, drawing up the timetable, organising traffic management, planning renewals, carrying out maintenance or setting the charge. The same page names the two public-use infrastructure managers and gives their networks as 1,229 km for AS Eesti Raudtee and 223.8 km for Edelaraudtee Infrastruktuuri AS, figures that neither manager's own network statement repeats.
