Transpordiamet is one of the six supervisory bodies listed in section 143(1) of the Railway Act, and section 143(6) defines its competence as checking compliance with the requirements set for railway undertakings, having regard to section 7 — the section that applies Regulation (EU) 2021/782 on rail passenger rights. It is the extrajudicial body for the offences in sections 167 to 170 of the Act, which are the passenger-rights offences, and under section 140 it issues the train driver licence on the basis of a decision of TTJA and administers the driver examination. It is not the national safety authority, it does not license infrastructure managers or railway undertakings, and it publishes no rail statistics series: its own statistics page lists driving schools, traffic accidents, vehicles, roadworthiness testing, mobility, state road traffic counts, the maritime economy and ship inspections, and nothing on rail. Its published role in rail procurement is as joint contracting authority with Rail Baltic Estonia for the road viaducts and junctions that cross the Rail Baltica route, because those structures carry state roads.
